1. ACCEPTANCE OF TERMS

These Terms constitute a binding legal agreement between you and GEMZ. If you do not agree with these Terms, you must not access or use our Website or Services.

Acceptance is deemed to occur either by:

By actually using the Services, in which case you acknowledge you have entered into a binding agreement with GEMZ.

2. DEFINITIONS

Customer: Any individual or legal entity using our Website to register, manage, or purchase a car wash subscription, including adding vehicle details, personal information, payment details, and service preferences.

Content: All data including but not limited to text, images, video, location data, messages, reviews, or any other media submitted, generated, or displayed via our Services.

Customer Content: Content uploaded, submitted, or transmitted by the Customer, including personal data, vehicle details, building/parking information, or reviews.

GEMZ Content: All content created by GEMZ, including but not limited to visual designs, pricing structures, copy, interfaces, software code, reports, databases, trademarks, and proprietary service processes.

Third-Party Content: Content, services, or integrations provided by third parties (e.g. payment gateways) that are accessible or embedded in the Website.

Services: The car cleaning and related services offered by GEMZ at designated residential parking locations, managed and booked through www.gemzcarwash.com.

3. ELIGIBILITY & CUSTOMER WARRANTIES

You must be at least 18 years old and legally capable of entering into binding contracts.

You warrant that all information provided during account creation and thereafter is accurate, current, and complete.

You are solely responsible for complying with all applicable laws and regulations in your jurisdiction and in the UAE when using the Services.

You consent to GEMZ processing your data in accordance with its Privacy Policy.

GEMZ relies on your representations and bears no liability for inaccuracies in your information.

4. SERVICE USAGE & WEBSITE ACCESS

Services are provided at your vehicle’s designated parking space without requiring keys.

Customers must ensure vehicles are accessible during scheduled service times and comply with building management rules.

All subscriptions, payments, cancellations, complaints, and upgrades/downgrades are managed exclusively via www.gemzcarwash.com.

GEMZ may suspend or block access to accounts or Services if Terms are violated.

5. ACCOUNT MANAGEMENT

Customers are responsible for maintaining the confidentiality and security of their account credentials.

You may not impersonate another person, create multiple unauthorized accounts, or provide false information.

You are responsible for all activities under your account and must notify GEMZ immediately of unauthorized use.

GEMZ reserves the right to suspend or terminate accounts for non-compliance or fraudulent activity without refunds.

6. SUBSCRIPTION, PAYMENT & BILLING

Services are offered on a recurring monthly subscription basis.

Subscriptions auto-renew monthly unless cancelled at least 48 hours before renewal.

Payments are processed via secure third-party payment gateways (Apple Pay, Google Pay, Debit/Credit Cards). GEMZ does not store payment card information.

Service will be provided only after successful payment. If payment fails, service will be suspended.

Any upgrades will be billed immediately at the prorated difference; downgrades take effect from the next billing cycle.

7. CANCELLATION & REFUNDS

Customers may cancel their subscription via the Website at any time. Services continue until the end of the paid billing period.

No refunds are issued for partial months or missed washes due to customer error (incorrect info, inaccessible vehicle, etc.).

Refunds will only be granted for specific promotional offers or trials explicitly stating refund eligibility.

Refunds, when applicable, are processed exclusively by the third-party payment gateway.

8. SERVICE LIMITATIONS & REFUSAL

GEMZ reserves the right to suspend or reschedule services due to public holidays, extreme weather, or health/safety risks to staff. Missed washes under such circumstances are not recoverable.

GEMZ may refuse service to vehicles deemed excessively dirty (heavy mud, sand, or residue) that cannot be cleaned using tools permitted by building management. Such determinations are at GEMZ’s sole discretion.

GEMZ is not responsible for delays or service failures caused by inaccurate customer details, restricted access, or building regulations.

9. CONTENT RIGHTS & CUSTOMER CONDUCT

GEMZ owns all intellectual property rights in its Website, Services, and Content. You may not copy, modify, or exploit GEMZ Content without written consent.

Inappropriate, illegal, or offensive Customer Content (including defamatory reviews or prohibited uploads) may be removed at GEMZ’s sole discretion.

You may not upload, transmit, or engage in activity that:

Violates UAE law, public order, or building regulations.

Infringes intellectual property rights or privacy of others.

Includes harmful code, spam, or deceptive advertisements.

Impersonates another person or entity.

GEMZ reserves the right to monitor Customer Content to ensure compliance.

10. THIRD-PARTY CONTENT & SERVICES

GEMZ integrates with third-party providers (e.g., payment gateways). Your use of such services is governed by their own terms and policies.

GEMZ is not responsible for the accuracy, availability, or security of third-party content or services.

11. INDEMNIFICATION

You agree to indemnify and hold GEMZ, its affiliates, officers, employees, and agents harmless from any claims, damages, liabilities, or expenses arising out of:

Your use of the Services.

Your Customer Content.

Your violation of these Terms or third-party rights.

GEMZ reserves the right to assume exclusive defense of any such matter at your expense.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

GEMZ disclaims all warranties (express or implied) regarding the Services.

GEMZ is not liable for indirect, incidental, special, or consequential damages including loss of profits, data, goodwill, or service availability.

GEMZ’s total liability for any claim is limited to the subscription fee paid for the affected billing period.

GEMZ uses eco-friendly cleaning products and trained staff but is not liable for pre-existing vehicle damage or issues arising from cleaning materials approved for use.

13. UPGRADES & DOWNGRADES

Customers may upgrade plans mid-cycle and will be charged the difference immediately.

Downgrades take effect from the next billing cycle; no refunds for the current period.

14. DATA PRIVACY

GEMZ collects and processes your personal data to deliver the Services in accordance with UAE law.

Customers may request deletion of their data in writing, subject to applicable laws.

15. VARIATIONS TO TERMS

GEMZ may update or amend these Terms at any time.

16. TERMINATION

GEMZ may suspend or terminate accounts for breach of these Terms or for misuse of Services.

Customers remain liable for outstanding payments at the time of termination.

17. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
